CHAPTER I. GENERAL PROVISIONS

1. Preliminary provisions

    • The krzysztofnyrek.eu online store is run by Krzysztof Nyrek with its registered office in Libiąż, 12/9 Ratowników Górniczych Street, 32-590 Libiąż, who does not conduct business activity.
    • These Terms and Conditions apply only to sales agreements concluded with a customer who is a consumer within the meaning of Article 221 of the Act of 23 April 1964. Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended, from now on referred to as the “Civil Code”)
    • The Terms and Conditions of the online store krzysztofnyrek.eu define the rights and obligations of the parties to the sales agreement concluded via distance communication.
    • The Regulations constitute a model agreement within Article 384 of the Civil Code

2. Definitions

The terms used in the Terms and Conditions shall have the following meanings:

    • Product – Publications on electronic media presented in the online store may be the subject of a sales contract.
    • Customer—A natural person at least 18 years of age who has total legal capacity, is a legal person, and an organizational unit without legal personality but can acquire rights and incur liabilities on its behalf. A client may be persons who are at least 13 years of age but under 18 years of age to the extent that they can acquire rights and incur obligations.
    • Consumer – A Client is a natural person who performs a legal transaction with the Seller that is not directly related to his professional or business activity.
    • Business days – Days of the week from Monday to Friday, excluding public holidays.
    • Account – A set of resources and rights on the Website assigned to a Registered User.
    • Service – A system of websites functioning on the Internet in the domain krzysztofnyrek.eu, we are managed by Krzysztof Nyrek, an online store.
    • Shop – A set of technological tools and websites based on which products are sold on electronic carriers in the domain krzysztofnyrek.eu.
    • Contract of sale – An agreement containing Krzysztof Nyrek’s obligation to transfer ownership of the Product or Products available on the Website to the Client and to release them, and on the part of the Client an obligation to collect the Product or Products and pay Krzysztof Nyrek the price of the product.
    • User – Customers place an order via the Website.
    • Registered User – An entity with an Account on the Website, established per the Terms and Conditions of the Website.

 

CHAPTER II. TECHNICAL ACTIVITIES CONSTITUTING THE PROCEDURE FOR PLACING AN ORDER

1. Ways to place an order

  • Orders can be placed on dedicated websites on the krzysztofnyrek.eu;
  • Before placing an order, you can familiarize yourself with the features of the Product, which will be helped by descriptions and photos posted on the Website. If you have any questions about the Products, please get in touch with us at customerSerwices@krzysztofnyrek.eu
  • To place an order, you need to provide the contact details required to deliver the ordered Products, select the payment method for the ordered Products, and select the delivery method (collection).
  • The Client must accept the Terms and Conditions and the Privacy Policy to conclude the Sales Agreement.
  • The product’s price binds the Client from placing the order.
  • Store prices are expressed in Polish zlotys (PLN).
  • The Company issues a sales document in electronic form, to which the Client agrees.
  • The delivery of products is available in the krzysztofnyrek.eu domain takes place via the e-mail address provided by the customer during the transaction registration, to which the information necessary to complete the transaction and receive the purchased product is sent.

2. Orders on the Website

  • Orders may be placed on the website by Users who have created an Account (Registered Users) or without creating an Account.
  • Placing an order on the Website requires providing contact details in the order form or confirmation that the data provided by the User Registered in their Account are data for delivering the ordered Products.
  • The rules for processing Clients’ personal data are regulated in the Privacy Policy applicable to the krzysztofnyrek.eu domain.
  • Krzysztof Nyrek immediately confirms the receipt of the order by sending a message to the e-mail address provided in the order confirming the receipt and acceptance of the order placed by the Client.
  • In exceptional cases, Krzysztof Nyrek will confirm the receipt and acceptance of the order by e-mail by contacting the Client at the previously provided e-mail address.

CHAPTER III. INFORMATION ON PRODUCTS, CONTENT OF THE CONTRACT AND HOW TO SECURE IT

  1. Krzysztof Nyrek is a seller responsible for the proper quality of the Products sold, including the obligation to provide the Customers with Products free from defects.
  2. The Store provides the Client, by publishing on the Website, with the following information regarding the Products:
    • the price of the Product and its unit price, unless they are expressed in the same amount, including customs duties and taxes,
    • the unit price of the Product offered in bulk,
    • information that is sufficient for the proper and complete use of the Product,
  3. Before placing an order, the Client is informed about the essential elements of the Sales Agreement, i.e., in particular about the type, model, and price of the Product or Products.
  4. The content of the Sales Agreement is recorded, secured, and made available by sending an e-mail message to the Client – in the case where the Client has provided an e-mail address,

CHAPTER IV. PAYMENT OF THE PRICE FOR THE PRODUCT

  1. At the stage of ordering the Products, the Client is informed about the possibility of paying for the product by paying with the use of an electronic purse PayPal (more on the website: www.paypal.com/pl);

CHAPTER V. CHANGING AND CANCELLING ORDERS, TRACKING ORDERS

  1. The order can be canceled only by contacting the Client at customerSerwices@krzysztofnyrek.eu. Registered Users cannot make changes or cancel the order through their Account.
  2. Cancellation of the order is possible up to 30 days from the order date.
  3. Registered Users can verify the order status in the Account.
  4. In the case of Clients who have not created an Account on the Website, it is possible to determine the status of the order by contacting the e-mail address customerSerwices@krzysztofnyrek.eu

CHAPTER VI. INFORMATION ON THE MANNER, TIME AND COST OF DELIVERY

  1. The ordered products are delivered to the customer at the e-mail address provided by him in the purchase form immediately after the payment is credited.

CHAPTER VII. PRODUCT LIABILITY

  1. Krzysztof Nyrek provides a 30-day warranty for products sold on the krzysztofnyrek.eu website. To submit a complaint, please email customerSerwices@krzysztofnyrek.eu.

CHAPTER VIII. RIGHT OF WITHDRAWAL, REFUNDS

  1.  Statutory right to withdraw from a Distance Sales Agreement.
  2. The Sales Agreement concluded by Krzysztof Nyrek with the Client through the Store is a distance agreement within the meaning of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827).
  3. The Client may withdraw from the Sales Agreement without giving reasons by submitting an appropriate statement of withdrawal to the e-mail address customerSerwices@krzysztofnyrek.eu within 30 days of receiving the Product. The withdrawal is effective if the declaration of withdrawal is sent 30 days before the date of receipt of the Product.

CHAPTER IX. FINAL PROVISIONS

  1. Changes to the Terms and Conditions
    • Krzysztof Nyrek is entitled to:
      • changes in prices and quantities of Products in the Store’s offer during the day,
      • withdraw individual Products from the Store’s offer,
      • introducing new Products to the Store’s offer,
      • conducting, changing, and canceling promotional campaigns in the Store,
      • making changes to the Regulations.
  2. The changes referred to in paragraph 1 do not apply to orders placed by the Client, which are carried out by the Terms and Conditions in the wording accepted by the Client before concluding the Sales Agreement.
  3. Law and Jurisdiction
    • Polish law applies to all legal relations arising from these Terms and Conditions. Any disputes will be resolved by the competent Polish ordinary courts.
  4.  Validity of the Terms and Conditions – The Terms and Conditions are effective from 21.05.2024.
